These Terms govern your access to and use of www.lakystar.net and purchases from our Store. By placing an order, you agree to these Terms.
1) Scope & Eligibility
1.1 These Terms apply to all sales of goods made through our Shopify website and to any related customer service communications.
1.2 You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase. If you buy on behalf of a business, you confirm you have authority to bind that entity.
2) Nature of Goods (Used, Vintage, Antique)
2.1 Our catalog consists primarily of pre-owned items (used, vintage, antique, modernariato). Signs of age—such as patina, wear, small imperfections, manufacturing irregularities—are normal and often part of an item’s charm and value.
2.2 We strive to describe condition faithfully and to photograph notable flaws. Color/texture may vary due to lighting and displays.
2.3 Unless expressly stated, accessories such as bulbs, batteries, cables, or frames are not included or are provided as courtesy items without warranty.
3) Product Information & Availability
3.1 Each listing is for a unique item; availability is not guaranteed until we confirm shipment.
3.2 Measurements are approximate. If exact sizing matters, contact us before purchase.
3.3 We reserve the right to correct obvious errors (typographical/price/description) and cancel orders with full refund.
4) Pricing, Taxes & Currency
4.1 Prices are shown in EUR and include VAT where applicable. Shipping, duties, and taxes (especially for non-EU customers) may be added at checkout or billed by customs.
4.2 For non-EU destinations, import duties, taxes, brokerage are the buyer’s responsibility.
5) Orders & Contract Formation
5.1 Your order is an offer to buy. A binding contract forms when we send a shipping confirmation or deliver the goods.
5.2 We may decline or cancel an order (with refund) in cases including suspected fraud, stock errors, or shipping restrictions.
6) Payment & Security
6.1 Payments are processed by third-party providers (e.g., Shopify Payments/PayPal/Apple Pay/Google Pay). We do not store full card data.
6.2 By submitting payment information you warrant you are authorized to use the selected method.
7) Shipping, Risk of Loss & Inspection
7.1 We ship to the address provided at checkout. Please ensure it is accurate.
7.2 Risk of loss passes upon delivery to the carrier for business customers and upon delivery to you for consumers, as permitted by law.
7.3 On delivery, inspect the parcel. If damaged, accept with reservation (where available) and notify us with photos within 48 hours (outer box, inner packaging, label, item) so we can file a carrier claim.
8) Returns & Refunds (30 Days)
8.1 Our Return & Refund Policy — 30 Days forms part of these Terms and is incorporated by reference.
8.2 In short: returns are accepted within 30 days of delivery; items must be returned in the same condition received, with suitable protective packaging.
8.3 Return shipping is paid by the buyer (including packing, insurance, and carrier fees), except where required by law or if we explicitly agree otherwise for damaged/not-as-described claims after review.

9) Condition, Authenticity & Attribution
9.1 We stand behind the authenticity of our vintage/antique pieces to the best of our knowledge and sources.
9.2 Attributions (maker, era, origin) are made in good faith based on available evidence; reasonable differences of expert opinion may exist.
10) Electrical, Lighting & Safety (Vintage Items)
10.1 Unless stated “tested and working”, vintage electrical items may be sold as decorative collectibles. If you intend to use them, have them inspected/rewired by a qualified professional in accordance with local standards.
10.2 We are not liable for misuse, improper installation, or use contrary to intended purpose or local safety codes.
11) Warranties & Legal Rights
11.1 Nothing in these Terms affects non-waivable consumer rights under applicable law (e.g., EU consumer protection).
11.2 For used goods, the statutory legal guarantee period may be reduced as permitted by law (where explicitly stated in the listing/checkout). This does not affect liability for lack of conformity existing at delivery within the legal framework.
11.3 For business customers (B2B), all warranties are excluded to the maximum extent permitted by law; goods are sold “as-is”.
12) Promotions, Coupons & Gift Cards
12.1 Promotions and coupons are subject to the terms stated in the offer and may not be combined. We may withdraw or modify promotions at any time.
12.2 Gift cards (if offered) are non-refundable to the extent permitted by law.
13) User Content & Reviews
13.1 If you post reviews or upload content to our site or social channels, you grant us a non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, modify, publish, and display such content for promotional and operational purposes.
13.2 Do not post unlawful, defamatory, obscene, infringing, or misleading content. We may remove content at our discretion.
14) Prohibited Uses
14.1 You may not: (a) violate any laws; (b) infringe IP rights; (c) upload malware; (d) scrape or harvest data without written consent; (e) interfere with site security; (f) misrepresent your identity or affiliation.
15) Intellectual Property
15.1 All text, images, logos, designs, and photographs on the Store are owned by Lakystar or used under license. You may not use them without prior written permission.
16) Limitation of Liability
16.1 To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages; loss of profits; loss of data; or business interruption.
16.2 For consumers, our liability for foreseeable loss resulting from our breach of these Terms shall not exceed the purchase price of the item(s) concerned, except where liability cannot be limited (e.g., death/personal injury caused by negligence, fraud).
17) Indemnity (B2B / Improper Use)
17.1 If you use items commercially or contrary to instructions, you agree to indemnify and hold us harmless from claims arising from such use to the extent permitted by law.
18) Force Majeure
18.1 We are not responsible for delays or failure to perform due to events beyond our reasonable control (e.g., natural events, strikes, carrier disruptions, pandemics, governmental actions).
19) Third-Party Services & Links
19.1 Our Store may include links or integrations with third-party services (payments, shipping). We are not responsible for third-party terms, privacy practices, or performance.
20) Governing Law & Dispute Resolution
20.1 These Terms are governed by Italian law, without prejudice to mandatory consumer protections in your country of residence.
20.2 For consumers, disputes may be brought before the courts of your place of residence. For business customers, exclusive venue is the court of Latina, Italy.

21) Changes to These Terms
21.1 We may update these Terms from time to time. Changes take effect upon posting on the website with the “Last updated” date. Material changes will be highlighted where appropriate.
